Policy Action Alert: Proposed Federal Rule Puts Funding – and Services – at Risk

A proposed federal rule could create serious legal and financial risks for Georgia nonprofits that receive federal funding, and the deadline to respond is March 30.

The U.S. General Services Administration (GSA) has proposed requiring all federal funding applicants, including nonprofits, to sign new certifications tied to recent executive orders and federal guidance on DEI, immigration, and other issues – under penalty of civil and criminal law. 

These certifications would apply to anyone registered in SAM.gov, the federal portal used to apply for and manage federal grants and contracts.

If this rule takes effect, Georgia nonprofits could face:

  • Legal and compliance uncertainty around what the certifications actually require
  • Increased exposure to audits, investigations, and costly legal challenges based on vague standards
  • A chilling effect that discourages organizations from applying for federal funding at all
  • Disruptions to essential services, particularly in communities already facing the greatest need
